Güvenilir Marka İsim (GUMİB) Belgesi’nin Hukuki ve Fikrî Sınai Haklar Yönünden Markaya Katkıları

The Contribution of the GUMİB (Trusted of Brand Name Certificate) to Trademark Protection in Terms of Legal and Intellectual Property Rights

A trademark is not merely a business name; it encompasses a company's reputation, market identity, perception of quality, and legal standing. Simply using a trademark is insufficient to protect these values; it must be grounded in a solid foundation of legal, technical, and intellectual property rights.

The GUMİB is a legal and technical analytical process, and an internationally recognized document that fulfills this requirement.

The GUMİB provides a framework compliant with copyright law, offering a protection mechanism that enhances the trademark's first use, originality, distinctiveness, sectoral significance, and legal validity.

1) It establishes a legal and technical foundation for the trademark name.

The GUMİB process is a comprehensive preliminary legal study addressing critical legal issues, such as trademark name similarity analysis, sectoral risk assessment, differentiation criteria, and suitability for use.

This study largely prevents future risks, such as:

Objections,

Similarity disputes,

Refusal of registration,

Cancellation claims, and

Confusion and unfair competition claims arising from use.

2) It provides the strength of "first identification and proof" that aligns with the logic of copyright.

The GUMİB serves as evidence supporting claims of first use, first creation, intellectual work, and trademark authenticity.

As with copyright declarations, it documents the following information:

Date of first creation,

Declaration of first use,

Report of authenticity, and

Identity and liability of the trademark owner.

Because of its documentation, it provides strong additional evidence for potential trademark rights claims. In this respect, the GUMİB is a protective identification and proof document, providing support under the Trademark Law and the Intellectual and Artistic Works Law (Law No. 5846).

3) It provides preventative protection under intellectual and industrial property rights (IPL 6769).

Since GUMİB documents the trademark owner's conscious, researched, and legal creation of the trademark, it strengthens the trademark owner's position in matters such as:

Bon-faith use,

Title claims,

Distinction assessment,

Confusion analysis,

Obtaining the trademark before applying for registration makes it more reliable and defensible in the future.

4) It provides legal advantages in the registration process.

The technical and legal analyses provided by GUMİB in applications submitted to the Turkish Patent and Trademark Office include:

Reducing the risk of rejection,

Enhancing distinctiveness,

Minimizing objection proceedings by identifying the risk of similarity in advance.

In this way, the trademark is built on a more solid legal foundation.

5) It constitutes strong evidence in unfair competition cases

In accordance with Law No. 6769 and the provisions on unfair competition in the Turkish Commercial Code (Articles 54-63 of the Turkish Trademark Law), the GUMİB certificate provides a strong legal basis that documents the following:

That the trademark was consciously established,

That it has undergone sector-specific research,

And that it meets the criteria of distinction and originality.

This document constitutes official documentation supporting the trademark owner's right to claim imitation, similarity, defamation, or consumer deception.

6) Enhances confidence in trademark transfers, licensing, and investment processes

In trademark transfers, licensing, partnership negotiations, and investment, GUMİB serves as a legally binding reference document that enhances brand value by demonstrating professional analysis, mitigating legal risks, and verifying authenticity.

It strengthens investor and stakeholder confidence.

7) Provides international proof and credibility

Given GUMİB's adherence to the ISTU quality system and compliance with EU/European Intellectual Property Office (EIPO) reliability standards, it enhances international credibility and the proven strength of the trademark.

In particular, pre-assessment and registration of the trademark offers a significant advantage in processes such as trademark exports, international trademark applications, international e-commerce, and global marketing activities.

8) GUMİB itself is registered as a security trademark with the Turkish Patent and Trademark Office. Registering

GUMİB as a security trademark strengthens the document's legal validity and enhances its official standing. Summary: GUMİB provides genuine trademark protection at the legal, official, intellectual, and international levels.

It strengthens the trademark's legal foundation,

provides evidentiary strength regarding intellectual and industrial property rights,

protects against the risks of unfair competition and counterfeiting,

ensures the registration process,

provides a record of "first identification and rights ownership" in accordance with copyright law,

and lends the trademark a professional image in the eyes of investors and official institutions.
